General conditions of sale

ARTICLE 1 – CONTRACTUAL NATURE OF THE TERMS AND CONDITIONS

By ordering on this site, the purchaser expressly accepts the application of these terms and conditions of sale which will alone govern the online sale between the seller and the purchaser.

ARTICLE 2 – PRODUCTS

The products are presented on our website as faithfully as possible. The photographs reproduced online are nevertheless only indicative illustrations. We will not be held liable for inaccuracies in the photographs figuring on our website and we invite the customer to refer to the description of each product for the details about it and/or contact us by email at info@hellolesfilles.com to obtain the information they require.

We reserve the right to add new products, to delete all or part of the products sold or presented on the website, to change their presentation or to stop marketing them.

ARTICLE 3 - PRICES

Our prices are denominated in euros, inclusive of tax and costs, exclusive of transport costs, referred to in article 4.

Our prices are not revisable, in principle, but we may apply to them any changes in VAT rates or new taxes that occur before the delivery date.

ARTICLE 4 - ORDER AND PAYMENT

Dispatch of the products will be made on full payment of the order, subject to stock availability.

Possible payment methods are: Bancontact, Maestro, Visa, Mastercard.

ARTICLE 5 – DELIVERY METHODS AND COSTS

The goods may, at the customer's choice, be collected  free of charge from the store during opening hours, or delivered to the address indicated by the customer, in Belgium, mainland France, Netherlands and the Grand Duchy of Luxembourg only.

If the customer chooses to take delivery of the order in the store, the order will be available at the store at Boulevard Raymond Poincaré 7/103 4020 LIEGE (BELGIUM), 72 hours after receipt of payment.

If the customer chooses to have the order delivered to a delivery address, the order will be dispatched by us within 3 working days of the date of receipt of the customer's payment, subject to stock availability.

The delivery costs depend on the weight of the package and include the packaging, handling and the cost of sending the package.

The customer is responsible for taking delivery of the product, either making sure that someone is at home to receive the package indicated on the purchase order, or by collecting the package from the DPD office within 14 days of receiving the delivery attempt notification. The price paid remains acquired by the seller if the purchaser fails to fulfil their obligation to take delivery of the goods.

ARTICLE 6 – COMPLAINTS

The customer is required to check the package on receiving it. If they should notice damage and wish to make a complaint, the customer should detail their reservations clearly and precisely on the delivery note and hand it over to the person delivering the package or send these complaints to us by registered letter or by email within 7 days of receiving the package.

ARTICLE 7 – RIGHT OF WITHDRAWAL

The customer has the right to withdraw from the contract signed, without giving a reason, within 14 days.

To exercise the right of withdrawal, the customer must notify us of their decision to withdraw from the contract within 14 days of receiving the goods, by sending an email to the address info@hellolesfilles.com. The customer will specify the number of the order they are withdrawing from in the notification. The reimbursement will be made into the account number from which the order was paid, save where otherwise specified by the customer.

The customer must return the good or goods to us unworn, unwashed, with the original label, within 14 days of communicating their withdrawal decision to us. Otherwise, the goods return will be refused. The return costs are payable in full by the customer.

In the event of withdrawal, we will reimburse the goods excluding delivery costs (and excluding return costs) within 14 days of the return of the goods in perfect condition.

ARTICLE 8 – CONSUMER GOODS GUARANTEE

In accordance with articles 1949 bis to 1649 of the Civil Code and when the customer has the status of consumer, we will be answerable for any non-conformity that may exist on delivery of the good and that may appear within two years of the same.

The fault will be considered non-existent if at the time the contract was signed, the consumer knew about this fault or could not reasonably have not known about it or if the conformity fault is imputable to them.

It is agreed that the consumer must inform us of any non-conformity in writing within 2 months of the day the fault was noticed. Failure to meet this obligation will entail the loss of the consumer’s rights.

ARTICLE 9 – FORCE MAJEURE

We will not be held liable for a failure to execute any of our obligations when this failure is due to a case of force majeure, especially in the event of fire, sleet, natural disaster, strikes, a generalised lack of supplies or of means of transport, etc.

ARTICLE 10 – RESERVATION OF OWNERSHIP

The products sold remain our property until the price has been paid in full.

ARTICLE 11 – PROTECTION OF PERSONAL DETAILS

We process the customer’s personal details solely for the purposes of the performance of the contract signed. The customer has the right to access their personal details and to rectify them. They also have the right to oppose their personal details being used for direct marketing purposes.

ARTICLE 12 – APPLICABLE LAW

Save mandatory legal provisions applicable in the event of a contract with a consumer, this agreement is governed by Belgian law.

ARTICLE 13 – COMPETENT COURTS

Without prejudice to the mandatory legal provisions applicable in the event of a contract with a consumer, any dispute directly or indirectly relating to this agreement will be under the exclusive jurisdiction of the courts of the judicial district of Liège, Liège division (justice of the peace of the 2nd district).
